Comedian Kevin Hart is being sued by his former friend, Jonathan T. Jackson.
Jackson, who is known professionally as J.T. Jackson, has accused Hart of submitting fabricated evidence to the Los Angeles County district attorney’s office in a lawsuit, according to a copy of the complaint obtained by USA TODAY.
The case is an update to Jackson’s existing lawsuit against Hart, which alleges that Hart violated a settlement agreement requiring him to publicly declare Jackson’s innocence in relation to Hart’s 2017 sex tape scandal.
Below, we share everything you need to know about the lawsuit against Kevin Hart and the comedian’s admissions.
Kevin Hart’s Sex Tape Admissions
In new court documents obtained by PEOPLE from the breach-of-settlement legal battle with Jackson, Hart states that he was on ecstasy the night before he cheated on his then-pregnant wife, Eniko Hart with Montia Sabbag.
The documents include a transcript of the 2017 deposition from Hart about the ‘sex tape scandal’ night, where he admits to “partying” with an unnamed friend.
Hart says that he initially declined “molly” because “I don’t really f— with drugs like that” but gave in to pressure after the friend promised that wouldn’t “let [Hart] do anything.”
Hart admits to putting it in his drink which was “watered down.”
“Because it’s in my drink, [I thought] I’m fine. I’m fine with drinking. The night is good. As the night goes, I’m now with the girl [Montia Sabbag] at the end of the night, okay?” Hart said.
Hart says that he went to bed fully clothed and that Sabbag climbed into the bed in a dress.
“I’m knocked out. Nothing happened that night. I did not have sex with that girl that night. I had sex with her the following morning. She woke me up.”
Hart addressed the alleged hidden camera when he stated, “”While we were having sex, out of nowhere, [Montia] was facing one way… She throws herself backward on the bed. And that was her attempt to get closer to the camera.”
“When she did that, I pulled her back. You never see me having sex in that area,” he continued.
“That’s when she got up, she then sat on the bench, which is in the clear camera view. She sat on the bench and started talking to me… She made sure that I did it in that area, so you could clearly see it was me in the room.”
Why Is Kevin Hart Being Sued?
In 2018, Jackson was charged with trying to extort Hart by threatening to release a video of the comedian with a woman who wasn’t his wife.
The charges were however, dropped and Jackson denies the “baseless” extortion allegations, stating that he had no involvement in the creation of distribution of the tape.
In 2021, Jackson said that the former friends agreed to an out-of-court settlement, which included an agreement that Hart would publicly state Jackson’s innocence.
In Jackson’s lawsuit against Hart, he states that Hart “wilfully deviated” from the “meticulously negotiated” wording from their 2021 settlement” when Hart didn’t acknowledge that Jackson didn’t have anything to do with the trying to extort him, instead writing that the charges “have been dropped” and that “I’m happy that that chapter of my life is over.”
Now however, Jackson has updated his lawsuit to further allege that Hart and the D.A.’s office contributed to false extortion accusations against him, which damaged his reputation.
The lawsuit alleges that Hart “fabricated evidence and provided misleading statements that contributed and led to [Jackson’s] wrongful implication and arrest.”
The actor says that even after the charges were dropped, the emotional stress impacted his PTSD, public image and job opportunities.
Jackson is claiming over US$12 million (AU$18,000).
